Facts
Jonathan Morrill and J.M. Productions (Morrill) (plaintiff) directed, produced, and edited a music video entitled “Video Marked” as a means to promote Billy Corgan (defendant) and his then-existing band, The Marked. Later, Corgan and his new band, The Smashing Pumpkins, released a long-form music video entitled “Vieuphoria” that contained short clips of images from Video Marked. Morrill thereafter brought suit against Corgan, arguing he was the sole owner of the copyright for Video Marked and Corgan’s use of the images in Vieuphoria without authorization infringed his copyright in Video Marked. Corgan moved for summary judgment, arguing he was a joint author of Video Marked and therefore could not be held liable for copyright infringement.
