Facts
Harry McCain conveyed a parcel of real property by deed to E.M. Anglin. The deed to Anglin was recorded, but not properly indexed. McCain conveyed the same parcel of property by deed to Lingo (defendant). Lingo did not find record of the improperly indexed deed to E.M. Anglin. Lingo conveyed the property to Mortensen (plaintiff). Anglin threatened to evict Mortensen from the property. Mortensen filed suit seeking damages for breach of covenants of title.
