Facts
Motorola Solutions, Inc. (Motorola) (plaintiff) sued its rival, Hytera Communications Corporation Ltd. (Hytera) (defendant), in federal court. Motorola charged Hytera with trade-secret misappropriation in violation of several statutes, including the Defend Trade Secrets Act of 2016 (DTSA), which defined misappropriation as wrongful acquisition, disclosure, or use of trade secrets. Motorola alleged that Hytera wrongfully acquired Motorola’s digital-radio trade secrets in Malaysia and then wrongfully used those trade secrets to make knockoff digital radios, which Hytera marketed and sold in the United States. Hytera moved to dismiss Motorola’s DTSA charges on the grounds that (1) the DTSA’s extraterritorial applicability did not extend to private civil actions such as Motorola’s suit and (2) the DTSA was inapplicable because the alleged theft of Motorola’s trade secrets occurred before the DTSA’s enactment.
