Facts
Mount Prospect State Bank (the bank) (plaintiff) owned a parcel of property that contained 70 to 77 mobile homes. The bank’s property was located in the village of Kirkland (the village) (defendant). The village provided garbage-collection services to 317 residences in the village. But the village did not provide garbage-collection services to the mobile homes on the bank’s property. The bank brought suit, contending that it was a denial of equal protection to exclude the mobile homes from garbage-collection services. The village filed a motion to dismiss. The trial court granted the motion. The bank appealed.
