Facts
Charles Mozzochi (plaintiff) accused Walter Muszynski of falsifying his application to the police department, failing to disclose that he had been arrested for a felony, and wrongfully obtaining unemployment compensation benefits. Muszynski sued Mozzochi, alleging that Mozzochi’s statements were false. Muszynski was represented by attorneys Bruce Beck and Kathleen Eldergill (defendants). After this litigation concluded, Mozzochi sued attorneys Beck and Eldergill for abuse of process. Mozzochi alleged that the attorneys pursued Muzynski’s case against Mozzochi even after learning that Mozzochi’s accusations against Muzynski were true. Mozzochi alleged that the attorneys took this course of action in order to injure Mozzochi and enrich themselves. Beck and Eldergill filed a motion to dismiss. The trial court granted this motion, finding that Mozzochi had failed to state a claim for abuse of process. Mozzochi appealed.
