Facts
Article 25 of the French civil code authorized the French government (defendant) to revoke the French nationality of a naturalized individual, subject to confirmation by the Conseil d’État (the French administrative court), in narrow circumstances during a limited period. Such a revocation was possible if the individual had attacked the fundamental interests of France or perpetrated an act of terrorism before becoming a citizen or during a 10- or 15-year period after naturalizing. The revocation could only occur if the individual retained another nationality, limiting the possibility of a person becoming stateless. The French government moved to revoke the naturalization of Ahmed S. (plaintiff). During proceedings in the Conseil d’État, Ahmed S. challenged the constitutionality of provisions allowing the revocation of his citizenship on terrorism grounds as contrary to principles of equality and nondiscrimination enshrined in the French constitution. The Conseil d’État sought a preliminary ruling from the France Constitutional Council on the constitutionality of the law that authorized the revocation of the French nationality of a naturalized French citizen.
