Facts
Frederick Mashard Murray (defendant) and Sharon Jones became romantically involved after Jones separated from her husband. While Murray and Jones were together, Jones engaged in a sexual relationship with her coworker Kevin Crumedy and became pregnant with his child. Murray became jealous of Crumedy and became violent toward Jones. Murray threatened Jones that he would shoot both her and Crumedy with his gun. Jones then left the area for a few days. Jones returned with her ex-husband and police officers to retrieve her belongings from the home she shared with Murray. After retrieving her belongings, Jones visited Crumedy at his home. Murray then showed up at Crumedy’s home and witnessed Crumedy and Jones hugging. Murray then fatally shot Crumedy. After the shooting, Murray told Jones that he loved her and had shot Crumedy because of the affair. The State of Georgia (plaintiff) prosecuted Murray for Crumedy’s death. Murray was convicted of voluntary manslaughter and a possession offense related to the gun. Murray appealed.
