Facts
Donald Noah (plaintiff) bought policies from Mutual Savings Life Insurance Company (Mutual) (defendant) insuring the life of Noah’s brother. After the brother died by drowning, Mutual refused most of Noah’s claim for indemnification. Noah sued. Even though the trial evidence suggested that the relationship between Noah and his brother was not close, the trial court entered judgment declaring that Mutual was obligated to pay out on the policies. Mutual appealed to the Alabama Supreme Court, arguing that Noah had no insurable interest in his brother’s life.
