Facts
Peter Nails (plaintiff) worked as a mechanic for Market Tire Company, Inc. (Market) (defendant). Market fired Nails. While working for Market, Nails had been required to provide his own tools. Market customarily gave terminated employees two to three days after termination to return to pick up their tools. Two days after Nails’s termination, he returned to Market to pick up his tools. The tools weighed about 800 pounds, and Nails claimed that he hurt his back while attempting to remove them. Nails filed a claim for workers’ compensation. Market argued that because Nails was not an employee at the time of his injury, his injury was not covered by workers’ compensation. The trial court agreed, and Nails appealed.
