Facts
Claudette Issa (defendant) was a driver registered with Uber Technologies, Inc. (Uber) (defendant), a software company that used a digital network to connect riders with drivers for prearranged rides. Uber had control over fares, branding, and marketing. Uber imposed quality standards and conducted background checks on drivers, and it offered insurance benefits to drivers. Uber handled disputes between drivers and riders and communicated with drivers and riders via the Uber app. Under Rhode Island law, companies like Uber were classified as transportation network companies, and drivers registered with such companies were deemed to be independent contractors. Issa’s contract with Uber stated that Issa was an independent contractor. Lokeshwaran Narayanasamy (plaintiff) used the Uber app to order a ride to the airport. Issa responded and picked up Narayanasamy. Issa’s vehicle crashed, and Narayanasamy sustained injuries. Narayanasamy filed suit against both Issa and Uber, claiming that Issa was negligent and that Uber was responsible for Issa’s negligence. Uber motioned for summary judgment, arguing that Issa was not employed by Uber.
