Facts
The Food and Drug Administration (FDA) sought to seize paperboard food packaging containing dangerous PCBs that tended to migrate to the food. The FDA argued that such material met the definition of adulterated food under the Food, Drug, and Cosmetic Act. Natick Paperboard Corp. (plaintiff) sued, arguing that the FDA had to wait until the chemicals actually migrated to the food before seizure and that the migration had to be intentional to meet the requirements of the act.
