Facts
The San Diego Clippers Basketball Club (the Clippers) (defendant) wanted to move its team from San Diego to the Los Angeles Sports Arena where the Clippers would compete for fans with the Los Angeles Lakers. After Raiders I, but prior to Raiders II, the NBA (plaintiff) decided not to risk trebled damages by refusing to schedule the Clippers’ games in the Arena and, instead, allowed the games to go forward but brought suit against the Clippers for a declaratory judgment that the NBA could lawfully prohibit the Clippers’ relocation. The district court dismissed the NBA’s suit and the NBA appealed. The Clippers filed a motion for summary judgment.
