Facts
The National Organization for Women, Inc., Delaware Women’s Health Organization, Inc., and Summit Women’s Health Organization, Inc. (health organizations) (plaintiffs) sued the Pro-Life Action League, Inc., and others (activists) (defendants) under the Racketeering Influenced and Corrupt Organizations Act (RICO) for taking action and conspiring to force clinics that provide abortion services out of business. In an effort to seek class-wide relief, the health organizations moved to certify two classes of plaintiffs: a class of women’s health centers where abortions were performed and a class of women who had availed or might avail themselves to the services of clinics that provide abortion services (in their reply memorandum, the health organizations modified the class of women to include those whose rights to services at health centers where abortions are performed will be affected). The activists opposed certification of both classes.
