National Refining Co. v. Benzo Gas Motor Fuel Co.
United States Court of Appeals for the Eight Circuit
20 F.2d 763 (1927)

- Written by Sarah Hoffman, JD
Facts
Benzo Gas Motor Fuel Company (Benzo) (plaintiff) was the only producer of a gasoline-benzo blend used in motor vehicles in Kansas City, Missouri. National Refining Company (NRC) (defendant) sold gasoline from filling stations in many states, including Kansas City. NRC distributed supposedly educational leaflets at its gas stations that claimed that gasoline-benzo blends should not be used in motor vehicles because their ignition process was explosive and caused damage to vehicle engines. Benzo filed suit against NRC for libel, and at trial, Benzo presented evidence that the statements in the leaflet were not true. The jury found for Benzo and awarded $1 in actual damages and $10,000 in punitive damages. NRC filed a motion for a directed verdict, which the trial court denied. NRC appealed.
