Facts
In another proceeding, the Food and Drug Administration (FDA) was ordered to initiate withdrawal proceedings for the use of certain antibiotics in animal feed. The court in that decision noted that the FDA had done nothing for over 30 years after giving the opportunity for hearings and determining the use of certain antibiotics in animal feed was unsafe. The FDA proposed a schedule to bring itself into compliance with the court order, and the National Resources Defense Council, Inc., sued, arguing that the FDA should have a court-ordered faster timetable because they had unreasonably delayed doing anything for 30 years.
