Facts
The Natural Resources Defense Council (plaintiff) sought a permanent injunction to prevent the United States Navy from peacetime use of a low-frequency sonar system for training, testing, and routine operations. The sonar was intended to find enemy vessels, but it was harmful to marine life. The Navy responded that enjoining the peacetime use of the sonar would harm national security because training and testing of the sonar was necessary for military readiness.
