Facts
Gordian Ndubizu (plaintiff) was a professor at Drexel University (defendant). Ndubizu claimed that the dean of his school promised to appoint Ndubizu to an endowed professorship. Ndubizu also claimed that, relying on this promise, he worked extra hours to increase his scholarly activity, impaired his health, and did not pursue other employment opportunities. Ndubizu was never given the endowed position and brought suit against the university and the dean for promissory estoppel. Ndubizu argued that injustice could be avoided only by enforcing the promise. The university moved for summary judgment, arguing that merely continuing to work and neglecting to seek other job opportunities is not sufficient to constitute promissory estoppel. Ndubizu was able to increase his prestige and personal reputation through his extra work. The case was heard by the United States District Court for the Eastern District of Pennsylvania.
