Facts
George Neary (plaintiff) obtained a $7 million jury verdict in trial court in a libel action against the Regents of the University of California (the university) (defendant). The university appealed, and Neary cross-appealed. While the appeals were pending in appeals court, the parties agreed to settle. Under the agreement, the university agreed to pay Neary $3 million, and, in a stipulated request, the parties jointly requested the appeals court to reverse the trial court’s judgment. The appeals court denied the parties’ request.
