Facts

In 1933, the State of New York (plaintiff) established the Milk Control Board, which had the power to fix the prices of milk sold by New York stores. Nebbia (defendant) owned a grocery store in Rochester, New York, and was convicted of selling milk at a price below the fixed price. The county court of appeals for Monroe County affirmed the conviction, and Nebbia appealed to the United States Supreme Court.
