Nelson v. Knight
Iowa Supreme Court
834 N.W.2d 64 (2013)
- Written by Darius Dehghan, JD
Facts
Melissa Nelson (plaintiff) was employed by James Knight (defendant). Melissa and James texted each other outside the workplace. Although James’s text messages to Melissa contained sexual comments, Melissa consented to receiving these messages. Jeanne Knight, James’s wife, found out that her husband and Melissa were texting each other. James fired Melissa because Jeanne viewed Melissa as a threat to her marriage. Subsequently, Melissa brought suit, contending that James had engaged in sex discrimination in violation of Iowa law. The trial court granted summary judgment to James. Melissa appealed.
