Facts
The defendants rented space in a shopping center from the plaintiff. The defendants operated a miniature golf course in the space. Shoppers in the shopping center and other people in the area frequently came onto the golf course and loitered even though they did not play. The defendants determined that the presence of the trespassers rendered their business no longer profitable, and they abandoned the premises. The plaintiff brought suit to recover the remainder of rent owed on the lease. The defendants claimed that the continued presence of the trespassers violated their right to quiet enjoyment of the premises and constituted a constructive eviction.
