Facts
NetApp, Inc. (plaintiff) sued Nimble Storage, Inc. (defendant) for civil damages under the Computer Fraud and Abuse Act (CFAA) after one of Nimble Storage’s employees copied data from NetApp’s computers and transferred it to a nonsecure device. Nimble Storage filed a motion to dismiss, arguing that the CFAA required a plaintiff to prove that its data was actually damaged, and that NetApp failed to and could not show that its data was damaged by mere copying.
