Network Solutions, Inc. v. Umbro International, Inc.
Virginia Supreme Court
529 S.E.2d 80 (2000)

- Written by Sean Carroll, JD
Facts
3263851 Canada, Inc. (the judgment debtor) registered the domain name umbro.com. Umbro International, Inc. (Umbro) (plaintiff) sued the judgment debtor in federal district court. The court granted Umbro an injunction, enjoining the judgment debtor from continuing to use the domain name. Pursuant to a registration agreement, the judgment debtor had registered 38 domain names with Network Solutions, Inc. (NSI) (defendant). NSI owned a right from the federal government to register domain names and to assign them to Internet Protocol addresses. Umbro instituted garnishment proceedings in state court and named NSI as the garnishee. Umbro sought garnishment of the judgment debtor’s right to use the 38 domain names. The district court ruled in Umbro’s favor and ordered NSI to place the domain names back into the registry to be sold. NSI appealed.
