Facts
Israel Neuberg had a car wreck and brought a suit against Bobowicz (defendant) for his injuries. Israel’s wife, Toby Neuberg (plaintiff), joined the suit, pleading a cause of action of loss of society, services, and sexual companionship. At trial, the Neubergs presented evidence that Israel’s injuries would prevent him from fathering a child. The trial court sustained Bobowicz’s objections to Toby’s loss-of-consortium claim, and Toby ultimately appealed to the Pennsylvania Supreme Court.
