Facts
Roger and Louise Neuhoff (plaintiffs) owned windows manufactured by Marvin Lumber and Cedar Co. (Marvin) (defendant). In 1998, as a result of decay in the windows, Marvin’s agent orally promised the Neuhoffs that Marvin would replace the windows once Marvin resolved its production problems and the decay became more advanced. The Neuhoffs later brought suit to enforce the promise. Marvin argued that the alleged promise lacked consideration. The district court granted summary judgment. Marvin appealed.
