Facts
Michael Rabin was a neurosurgeon and shareholder of Neurosurgery and Spine Surgery, S.C. (Neurosurgery). Mary Goldman (plaintiff) was a patient of Rabin’s partner. Rabin treated Goldman in the hospital. Goldman called the hospital and alleged that Rabin had forced his way into her room while she was undressed, had examined her with the door open, and had been dismissed from the staff of other hospitals for similar conduct. Rabin and Neurosurgery sued Goldman for defamation. Goldman brought a third-party complaint against Nancy Skaletsky (defendant), who was Rabin’s partner’s wife and a nurse employed by Neurosurgery. Goldman alleged that Skaletsky had told Goldman that Rabin had been dismissed from other hospitals for similar conduct, that Skaletsky’s purpose was to induce Goldman to publish the false statement to the hospital, and that Goldman had suffered physical and emotional distress and incurred legal fees and other costs as a result of her reliance on Skaletsky’s false misrepresentations. The court dismissed Goldman’s third-party complaint against Skaletsky. Goldman appealed.
