Facts
In early-1991, J.E. (defendant) was indicted on two counts of aggravated sexual assault, including acts of sexual penetration, against C.R. and M.B. In June 1991, J.E. entered into a drug-rehabilitation program at The Harbor, a drug-abuse clinic. In October 1991, J.E.’s probation officer informed the Hudson County prosecutor’s office of the state of New Jersey (plaintiff) that J.E. had tested positive for HIV at The Harbor. New Jersey filed a motion asking the court to order the release of J.E.’s medical records regarding the HIV test to the state in order to inform C.R. and M.B. of the results because of the possibility that they had been infected as a result of J.E.’s sexual assault. J.E. refused to consent to the release of his medical records.
