Facts
Jose Gonzalez (defendant) rented a residential unit from New York East Coast Management (East Coast Management) (plaintiff). Gonzalez made habitually late rent payments. Subsequently, East Coast Management sent Gonzalez a notice to vacate the unit. Gonzalez spoke only Spanish, but the notice to vacate was in English. After Gonzalez failed to vacate his unit, East Coast Management filed a complaint to evict Gonzalez. Moreover, Gonzalez was not entitled to relocation assistance. Gonzalez filed a motion to dismiss East Coast Management’s complaint, holding that the notice to vacate was void under the New Jersey Superior Court’s earlier ruling in 5000 Park Associates v. Collado. The trial court took the motion under advisement.
