Thousands of investors (investors) (plaintiffs) sued Dean Witter Reynolds, Inc. (Dean Witter) (defendant) for securities fraud in violation of the Securities Exchange Act of 1934 and Rule 10b-5. Investors filed a petition for class certification under Federal Rule of Civil Procedure 23, but the district court denied the petition. Investors filed an interlocutory appeal of the district court’s denial of class certification.
