Facts
Nichols (plaintiff) retained attorneys Fulfer and Keller (defendants) for representation in a workers’ compensation claim. Fulfer and Keller did not advise Nichols that he might also be able to pursue civil tort claims. Nichols learned about the potential for additional claims only after the statute of limitations on those claims had run. Nichols brought legal malpractice claims against Fulfer and Keller for failing to inform him about his additional claim options. The trial court granted summary judgment in favor of Fulfer and Keller. Nichols appealed.
