Facts
Mr. Nichols (defendant) arranged for a box to be shipped in the freight car of a train. Nichols then concealed himself in the box. The box was loaded on to the train. Nichols intended to rob the train, but was discovered before he could do so. Nichols was prepared to kill anyone who threatened to stop the theft. Nichols was convicted of burglary. He appealed.
