Facts
A general contractor subcontracted project architectural and engineering work to firms that included Turner/Cargile and Korda/Nemeth (firms) (defendants). The firms were contractually obligated to visit the worksite and make sure the construction work generally proceeded in accordance with each firm’s design specifications. In the course of one such visit, firm representatives allegedly observed a third-party subcontractor cantilevering steel beams unsafely. A few days later the beams collapsed, killing several workers. Beth Nicholson and other survivors of the victims (survivors) (plaintiffs) unsuccessfully sued the firms and their representatives for negligence. The survivors appealed the trial court’s judgment to the Ohio Court of Appeals. Turner/Cargile was not party to the appeal.
