Facts
A court ordered mediation in the case Virginia Moorehead v. Hovensa. After the mediation, Hovensa (defendant) moved for sanctions against Heidi Nielsen-Allen’s counsel (plaintiff) (plaintiff’s counsel) for disclosing the settlement amount reached in the present case during the Virginia Moorehead mediation. Hovensa claimed that the plaintiff’s counsel’s disclosure of the settlement amount in this case was in bad faith and therefore sanctionable. The plaintiff’s counsel responded that the disclosure was in the context of mediation, was confidential, and that Hovensa’s own motion (which described the mediation) was itself an impermissible disclosure of confidential information. The plaintiff’s counsel therefore argued to strike Hovensa’s motion for sanctions.
