Facts
Nielson (defendant), a resident of Washington, had a state license to operate a purse net on the Columbia River. While Nielson was on the river, within the limits of the State of Washington, he was arrested by Oregon law enforcement officers. Nielson was charged with, and convicted of, violating an Oregon law which prohibited the use of a purse net on the Columbia River. The appellate court and Oregon Supreme Court affirmed the conviction and the U.S. Supreme Court granted certiorari to review.
