Facts
The City of New York (defendant) intended to renew an insecticide-spraying program in an effort to control mosquitoes that carried the West Nile virus. No Spray Coalition, Inc. (No Spray) (plaintiff) sued the city in district court seeking an injunction against the renewed spraying under the Resource Conservation and Recovery Act. The act generally allows injunctive relief to prevent imminent harm from solid-waste handling. The district court denied No Spray’s request for an injunction, and No Spray appealed.
