Facts
Nolan (defendant) was the office manager of the Federal Discount Corporation (FDC), a finance company that made loans and collections. As customers made payments, the money was placed in a cash drawer. At the end of the day, Nolan’s accomplice prepared a report showing the day’s cash receipts. Nolan then took some of the cash from the drawer and the accomplice recomputed the adding tapes to equal the remaining cash. Nolan was charged and convicted of embezzlement. Nolan appealed, arguing that the evidence showed larceny and not embezzlement.
