Facts
The Montgomery County, Maryland county council (council) (defendant) amended its general zoning plan to limit the municipal services that could be extended to the Olney area, a self-sufficient, relatively remote, and lightly populated part of the county. The council’s action represented a carefully considered, good-faith effort to promote the public welfare by controlling urban sprawl. Norbeck Village Joint Venture and other Olney landowners (plaintiffs) sued to overturn the amendment. The landowners accused the council of amending the general plan in order to avoid having to exercise the county’s power of eminent domain, which would force the county to compensate the landowners for restricting their development rights. When the trial court upheld the rezoning, the landowners appealed to the Maryland Court of Appeals.
