Facts
Norris (plaintiff) owed money to Moskin Stores, Inc. (defendant). Moskin hired Nathan to collect the debt. Nathan’s agent called Norris’s family members claiming that her name was “Doris” and that Norris had had an affair with “Doris,” gotten her pregnant, and that “Doris” needed to locate Norris. Norris sued Moskin for invasion of privacy, claiming “Doris’s” phone calls embarrassed him, wrecked his marriage, and caused him mental anguish. The court found that Norris had failed to state a valid claim for invasion of privacy. Norris appealed to the Alabama Supreme Court.
