Facts
The Louisiana Department of Environmental Quality (DEQ) (defendant) granted a permit to Exxon Chemical Americas (Exxon) to build a polypropylene plant located in a nonattainment area for ozone pollution. Nonattainment signifies that an area has failed to meet the National Ambient Air Quality Standard for specific pollution. North Baton Rouge Environmental Association (NBREA) (plaintiff) and the Louisiana Environmental Action Network (LEAN) sought judicial review of a DEQ decision to grant Exxon’s permit. The district court ruled in favor DEQ. The district court held that DEQ did not abuse its discretion in granting the permit to Exxon. The district court denied NBREA and LEAN’s application for rehearing. NBREA and LEAN appealed.
