Facts
Chief United States Immigration Judge Micahel Creppy (defendant) issued a directive creating a category of deportation hearings called “special interest” hearings. The directive provided a framework for extra security measures that should be applied in special-interest cases, including closing hearings to the public and press. An association of media groups (plaintiffs) brought an action in the United States District Court for the District of New Jersey against Attorney General John Ashcroft (defendant) and Creppy, seeking access to special-interest deportation hearings, which involved persons believed to be connected with the September 11th attacks, arguing that there was a First Amendment right of access to such hearings and that the Creepy Directive was therefore unconstitutional.
