Facts
Property owned by Northwestern University (plaintiff), located within Evanston, Illinois, was exempt from property taxes. Northwestern refused to make financial contributions to the city to help pay for city services, which led to a long-term dispute between Northwestern and the Evanston City Council. The city council enacted a historic-preservation district that encompassed several properties owned by Northwestern. Northwestern filed a lawsuit pursuant to 42 U.S.C. § 1983 against the city, alleging a violation of equal protection. The city filed a motion for summary judgment. Northwestern presented direct evidence that at least four of the six members of the Evanston City Council acted with discriminatory intent.
