Facts
Norway (defendant), through the Norwegian Public Roads Administration, awarded a procurement contract directly to Micro Design, a Norwegian company. The procurement contract was single tendered to Micro Design and was for the purchase of electronic toll-collection equipment for a toll system around the city of Trondheim. The procurement contract included research and development and the delivery of a prototype. The United States challenged the award of the contract and asserted that Norway had violated the Government Procurement Agreement, which generally required parties to extend national treatment to foreign goods in government procurement. Norway argued that its single tendering of the contract was justified under the exception covering the procurement of prototypes and research and development.
