Facts
Keiona Nowlin (defendant) and her boyfriend, Demarcus Degrate, were leaving Degrate’s home when they saw United States marshals approach. The marshals heard Nowlin yell at Degrate to run, and she and Degrate both fled. At the time, Degrate was out on bond on state charges. In addition, federal charges had been filed against him, but that indictment was under seal. Neither Degrate nor Nowlin was aware of the federal charges. Both Nowlin and Degrate were eventually caught and arrested. Nowlin was charged and convicted of hindering apprehension on the basis that she warned and encouraged Degrate to run from law enforcement. Her charge was upgraded to a third-degree felony because she hindered Degrate’s arrest for a federal felony. Nowlin appealed, arguing she did not know Degrate was charged with a felony offense and therefore could not warn him to evade officers seeking to arrest him for it.
