Facts
Jeweral Wayne O’Bar died in an automobile accident while driving a truck owned by his employer. As a result of the accident, O’Bar’s family (collectively, the family) (plaintiff) received more than $5,000 in workers’-compensation payments. At the time of O’Bar’s accident, O’Bar had an automobile-insurance contract with MFA Mutual Insurance Co. (MFA) (defendant). The MFA contract included a $5,000 accidental-death benefit. The family submitted a claim to MFA for the accidental-death benefit. MFA declined the claim, based on a provision in the insurance contract that stated the accidental-death benefit would be reduced by any amount paid under workers’-compensation law. The family sued MFA for the accidental-death benefit. The trial court granted summary judgment in favor of MFA. The family appealed.
