O'Brien Bros. v. The Helen B. Moran
United States Court of Appeals for the Second Circuit
160 F.2d 502 (1947)

- Written by Alex Ruskell, JD
Facts
The Helen B. Moran (defendant), a Navy tugboat, sunk a 12-year-old barge owned by O’Brien Bros. (plaintiff). O’Brien sued for damages, and both sides offered several different estimates of the proper damages owed to O’Brien. The district court measured damages by adding together the cost of raising the barge, repairs, future repairs, and losses suffered while the barge was unable to be used. The Moran appealed.
