Facts
Ocean Atlantic Woodland Corporation (Ocean Atlantic) (plaintiff) sued DRH Cambridge Homes, Inc.; Pugsley & LaHaie, Ltd.; and Cowhey, Gundmundson, Leder, Ltd. (defendants) for copyright infringement in the United States District Court for the Northern District of Illinois. Ocean Atlantic sought extensive discovery from the defendants. However, the district court observed that there were considerable issues suggesting that Ocean Atlantic would be unable to establish the defendants’ liability. Pursuant to Rule 42(b) of the Federal Rules of Civil Procedure (FRCP), the defendants moved to have the discovery stage bifurcated into two stages. The defendants requested that discovery initially be limited to the issue of liability, with the parties reaching the issue of damages only if the liability of the defendants was established.
