Facts
The Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2006 added additional requirements for fishery management plans. One of these requirements was that plans utilize the best scientific information available. The Pacific Fishery Management Council (council) proposed a new rule setting overfishing limits, acceptable biological catches, and annual catch limits for northern anchovy. Oceana, Inc. (plaintiff) sued, arguing that the new rules were invalid because they were not based on the best scientific information available. Specifically, Oceana claimed the scientific information used by the council was outdated. The council responded that the newer scientific information presented by Oceana in support of its claim was unreliable.
