Facts
Oceanic Transportation Corporation of Monrovia (plaintiff) and Alcoa Steamship Co. (defendant) entered a contract containing an arbitration clause. A dispute arose between the parties, and the parties entered arbitration. The arbitration tribunal heard arguments on whether to subpoena a specific witness and whether to order the production of certain documents as part of that subpoena. The arbitration tribunal entered the subpoena, finding that the witness’s testimony and the documents sought in the subpoena contained information material to the arbitration. The witness wrote to the parties, stating that unless directed by the court, the witness would not answer the subpoena. A motion for contempt was filed in the United States District Court for the Southern District of New York, seeking the court to sanction the witness’s failure to respond to the subpoena. The motion also sought for the district court to compel the witness to testify before the arbitration panel as ordered by the subpoena issued by the arbitration panel.
