Facts
Heinrich Engel (debtor) filed for Chapter 7 bankruptcy. Attorney Stephen Bresset (defendant) endorsed the bankruptcy petition as counsel for Engel. An associate met with Engel several times and prepared bankruptcy schedules showing the value of Engel’s real estate assets as $58,000. Bresset knew there was an appraised valuation of $132,000. Bresset reviewed the schedules outside of Engel’s presence. Engel signed the schedules in the presence of Bresset’s secretary but did not read them. The United States trustee (plaintiff) requested that the court sanction Bresset for undervaluing Engel’s real estate.
