Facts
In 1955, the Association of the United States Army (defendant) published a book called "Combat Actions in Korea." The book criticized the handling of a platoon that Lawrence Ogden (plaintiff) had commanded during an engagement in Korea. In 1959, Ogden brought a libel action against the Association in federal district court in Washington, D.C. The Association moved for summary judgment, arguing that the action was barred by the District of Columbia's one-year statute of limitations for libel actions.
